The Coca-Cola Company has sued China's
trademark review board for rejecting its application for trademark protection
on the bottle design of its Fanta soft-drink brand, National Business Daily reports. The application, which covered the
pattern of dimples and grooves in the bottom half of the plastic bottle, was
rejected by the office for lacking creativity; since so many bottled drinks
currently come in grooved and dimpled bottles, the office found that Fanta's
particular markings were not readily distinguishable from any other brand's.
Coke seeks to demonstrate to the court that its design is in fact unique and
worthy of protection.
